Juli 2025 (Az. 6 AZR 18\/25) hat das Bundesarbeitsgericht entschieden, dass Arbeitsvertr\u00e4ge, die mit Erreichen der Regelaltersgrenze automatisch enden, nicht unter den Diskriminierungsschutz des \u00a7 4 Abs. 2 TzBfG fallen.<\/p>\n<p>&nbsp;<\/p>\n<h2>Hintergrund des Falls<\/h2>\n<p style=\"text-align: justify;\">Eine Arbeitnehmerin war befristet besch\u00e4ftigt und machte geltend, sie werde gegen\u00fcber unbefristeten Besch\u00e4ftigten und Beamten benachteiligt, da ihr Vertrag mit Eintritt in die Regelaltersgrenze enden sollte. Sie berief sich auf das Gleichbehandlungsgebot. Das BAG wies die Klage ab: Die gesetzlich vorgesehene Befristung bis zur Altersgrenze sei zul\u00e4ssig und keine verbotene Diskriminierung.<\/p>\n<p>&nbsp;<\/p>\n<h2>Bedeutung der Entscheidung<\/h2>\n<p style=\"text-align: justify;\">Das Urteil schafft Rechtssicherheit f\u00fcr Arbeitgeber. Befristungen bis zur Regelaltersgrenze sind weiterhin wirksam, ohne dass ein Anspruch auf Gleichstellung mit unbefristeten Besch\u00e4ftigten besteht.
