Compensation for pain and suffering on the rise!

The Aurich Regional Court led the way with its ruling of 23/11/2018 and the Giessen Regional Court followed suit with its ruling of 08/11/2019. Both courts awarded the plaintiffs in their cases a Compensation for pain and suffering in the amount of € 800,000 to.

This is an absolute novelty, as the unspoken magic limit for compensation for pain and suffering was previously €500,000. No court has ever gone higher when assessing compensation for pain and suffering.

In the two cases that have now been decided, the injured parties were very young and had to suffer considerable health impairments for the rest of their lives as a result of incorrect medical treatment.

These decisions reflect a trend that is increasingly finding its way into German courts. The amounts of compensation awarded are increasing. We are still a long way from the American level, but it is a step in the right direction.
